HB 931 - This act authorizes a law enforcement officer, with approval of the court, to collect representative samples of hazardous materials seized as evidence in a criminal investigation and destroy the remaining material. The representative sample accompanied by documentation verifying the identity and quantity of the material shall be deemed competent evidence of the hazardous material and shall be admissible in any proceeding. In a proceeding involving a violation of Chapter 195, RSMo, in which quantity is an element, sufficient quantity of a hazardous material shall be maintained necessary to prove the amount alleged.
A law enforcement officer with custody of seized property
may request, at any time after the property is not useful as
evidence, that the prosecuting attorney file a motion requesting
an order for disposition of the property. If the prosecuting
attorney does not file the motion within sixty days, the officer
having custody of the property may request the Attorney General
to file such a motion.
